The data protection declaration of iMATRIX GmbH, Cheerstrasse 13e, 6014 Lucerne, Switzerland (hereinafter referred to as “imatrix.ai”) applies to all users whose personal data is processed by imatrix.ai. This applies to customers who have concluded a service contract with iMATRIX GmbH, its employees and website visitors. The privacy policy may also apply to other contractual partners on a contractual basis.

iMATRIX GmbH is responsible for the safe and responsible handling of personal information of its customers. It is ensured that the data is protected and that the Swiss Data Protection Act (DSG) for data of Swiss customers and the EU General Data Protection Regulation (DSGVO) for data of customers from the EU area are complied with. Together with our hosting providers, we work to protect the databases as best as possible against unauthorized access, loss, misuse or manipulation.

2. Legal basis

Data processing by imatrix.ai is subject to the applicable legislation.

The processing of data from customers in Switzerland is carried out in accordance with Swiss data protection laws.

The processing of data of customers from Switzerland is exclusively subject to Swiss law, in particular the Swiss Federal Act on Data Protection (FADP, SR 235.1) and the associated Ordinance to the Swiss Federal Act on Data Protection (SR 235.11). The EU General Data Protection Regulation (GDPR) does not apply. However, the DSGVO may apply in expressly provided sections of this Privacy Policy and in special circumstances where it is mandatory for data of Swiss customers.

The processing of personal data of customers from the EU area is subject to the provisions of the EU General Data Protection Regulation (GDPR).

In addition to the applicable Swiss law, the processing of personal data of customers from the EU area is also governed by the General Data Protection Regulation (GDPR) of the European Union pursuant to Regulation (EU) 2016/679. 3. Collection of personal data when visiting our website (without login)

When visiting the website outside the protected login area, general technical visit information is automatically collected. This includes the IP address of the device used, which is anonymized by Google so that no assignment to the customer is possible. Google uses the method “_anonymizeIp()” for this purpose. Information on the browser type, the Internet service provider and the operating system is also collected.

When using imatrix.ai (with login)

During test access and paid use of imatrix.ai in the login area, all customer data entered or submitted during the registration and usage process is stored. This includes registration, orders, filling out online forms, participation in surveys or contests, and communication with the provider via social media, blogs, or other interactive media. As a rule, personal data such as name, address and e-mail address are collected, as well as the required settings for the respective service. Further information on data processing and its purposes can be found in the order processing agreement. By collecting the data, the customer consents to the processing, use and disclosure of the personal data within the scope of the purposes described in this privacy policy.

Data exchange with third parties / processors

The customer may share his data with third parties, such as his employees or partners, either directly or within imatrix.ai. By granting access rights, the customer agrees that imatrix.ai may provide or allow third parties (e.g. employees or partners) to access all of the customer’s data. The customer always retains full control over the access rights of third parties to his data and can restrict or deny access at any time. In addition, imatrix.ai offers the possibility for the third party (e.g. employee or partner) to open an account as a customer himself. In this case the third party or employee or partner manages the access rights and can grant, restrict or deny them to third parties. However, imatrix.ai reserves the right to release certain data to authorized third parties in justified individual cases.

Third-party consulting services

The imatrix.ai offers customers consulting services from third-party providers. In order to verify customer eligibility and provide the necessary contact information to the third-party providers, the following data is passed on: Name/company of the company, address (street, postal code, city, address additions), concluded contracts between imatrix.ai and the customer, telephone numbers and e-mail addresses. Reference is made to the privacy policy of the respective third party provider in its current version.

Other partner functions

When using additional optional partner functions of the imatrix.ai or the API connection of the own account to a partner, a data exchange takes place between the imatrix.ai and the corresponding partner.

4. Data security

The provider takes technical and organizational security measures in accordance with recognized market standards to protect stored personal data against accidental, unlawful or unauthorized manipulation, deletion, alteration, access, disclosure, use or partial or total loss. The provider’s servers are located in Switzerland. The connection to the servers is made via SSL encryption. The provider regularly backs up customer data (backups) to prevent data loss even in extreme cases. The requirements of the DSG and the DSGVO are fully complied with at all times. The security measures are continuously adapted and improved according to the state of the art. The provider assumes no liability for the loss of data or their knowledge and use by third parties. The provider cannot guarantee the security of data transmission on the Internet. In particular, there is a risk of access by third parties when transmitting data by e-mail. However, access takes place via HTTPS. If expressly desired, the customer can choose two-factor authentication at any time.

5. Purposes of data processing / data recipients

The imatrix.ai uses the data collected to continuously improve products and services, to manage access to applications, information and products, to maintain business relationships with customers, to monitor and improve the performance of the offering, to identify, prevent or detect illegal activities and to provide customers with offers, information or marketing material regarding potentially interesting products or services. The data may also be disclosed to partner companies, service providers, selected third parties, institutions and/or legally authorized government authorities for these purposes. If the processing or storage of personal data takes place in countries that do not ensure adequate data protection compared to Swiss data protection law, the imatrix.ai contractually ensures that the processors comply with the relevant provisions of the Swiss Data Protection Act (DPA) or the General Data Protection Regulation (GDPR), as far as this concerns the data of customers from the EU area. The imatrix.ai commissions data protection-compliant service providers within the EU or Switzerland with certain processes and services, in particular in the areas of IT services, payment transactions, printing services, billing, collection, consulting, sales and marketing.

6. Processing of personal data

Personal data refers to any information relating to an identified or identifiable individual. A data subject is a person whose personal data are processed. Processing includes any handling of personal data, regardless of the means and procedures used. This includes, in particular, the storage, disclosure, acquisition, erasure, retention, alteration, destruction and use of personal data.

We handle personal data in accordance with the data protection laws of Switzerland. If the EU GDPR is applicable, we additionally process personal data in accordance with the legal basis in connection with Article 6 (1) of the GDPR.

In general, we process your data for the following purposes:

  • To fulfill and settle obligations stipulated in a contract or by law.
  • To inform you about updates or changes to our offers or events, as well as adjustments to our T&Cs, privacy statements and specifications that relate to how you may advertise on our portals and websites.
  • To verify your access authorization and to manage your user account (if any).

Below we have listed in detail for you which data is processed as part of our offers, for what purpose we process it and which legal basis applies to the processing.

6.1 Access to our offers

If you use our offers without providing any further information, general technical visit data is automatically collected and stored in log files. This technical information includes, among other things, the IP address of the device used from which access is made, information on the browser type used, Internet provider and operating system, which offers on our website were called up, reference and exit pages, and the duration and time of access.

In order to enable the use of our website (connection establishment), to ensure the security and stability of our systems and offers and to analyze the use of our offers and services, general demographic data is collected. If you visit our offers and personal data is processed for the purposes described above, this is done in our legitimate interest to support the connection setup and to ensure the security and stability of our systems and offers. Likewise, it serves the analysis, statistical evaluation, adaptation and improvement of the use of our offers as well as the optimization of our internet offer.

6.2 Create a user account

First and last name, e-mail address and password. This data will be kept confidential and used only for the specified purpose. You can change or delete your personal data at any time by accessing your user account. By registering, you agree to our Terms of Use and Privacy Policy.

You have the option to voluntarily enter and store additional personal information in addition to the mandatory information required to use a particular offer. When registering, you must confirm that the information provided for your user account is correct.

We use your data for the administration and implementation of our digital offers and to verify plausible information. The data will be used for the establishment, administration, modification and execution of contracts concluded with your user account, as well as for proper invoicing if chargeable services are used. We process your data in accordance with the applicable data protection laws.

6.3 Offers

We collect statistical data during the use of our offer by registered users. For the purchase or receipt of a paid offer, you must provide mandatory personal data such as first and last name, full address (postal address, zip code and city) and possibly other data (eg shipping address, billing address, payment information, etc.). We need this data in accordance with the applicable data protection regulations in order to process the contract with you. If you choose an online payment option such as credit card, Stripe, TWINT or PayPal, the payment will be made via the online payment system of the respective provider. Personal and payment data are processed directly by the payment system provider. We have no knowledge of your payment data and do not store them. The data protection provisions of the corresponding online payment system apply in addition.

The data we collect from you for the purchase or receipt of a paid offer may be used for future purchases or contract conclusions in accordance with our internal archiving and data protection guidelines or the legal requirements in your user account. We use this data to optimize, improve and further develop our offer, for marketing purposes and for statistical purposes. Here, all information regarding your previous and current purchases and contract conclusions (such as products, services, number of products and services per purchase as well as payment amount) may be stored.

6.5 Contact via chat or contact form

When you contact our customer service, we may process your contact information (such as title, first and last name, phone number, email address or postal address) and the content of the conversation to respond to your inquiry. This is done in order to provide you with an appropriate response and to process your request correctly. We base this on our legitimate interest under applicable data protection law. If you have given your consent, consultation sessions with customer service may be recorded and stored for training and quality purposes.

If you fill out a contact form or use a chat on our website, the personal data entered, such as title, first and last name, telephone number, e-mail address or postal address and the content of the request will be processed by us. This is done for the purpose of providing information and to process your request appropriately, based on our legitimate interest and in accordance with applicable data protection law.

6.6 Contest or Sweepstakes

We use your voluntarily provided data, such as title, first and last name, e-mail address and postal address, to organize and conduct events and to notify and/or publish winners, either directly or via social networks. There is also the possibility that your data will be passed on to third parties, for example if the implementation or evaluation of the event has been commissioned by a third party or if the event is handled by a third party via our offers.

6.8 Analysis and marketing

7. Cookies

Cookies help to make visiting the imatrix.ai website easier, more pleasant and more useful. The imatrix.ai website uses Google Analytics, a web analysis service provided by Google Inc., which is based in the USA (1600 Amphitheatre Parkway, Mountain View, CA 94043). Google Analytics uses cookies, which are text files placed on the customer’s computer, to help the website analyze how users use the site. The imatrix.ai website also uses the “demographic features” provided by Google Analytics. This allows reports to be generated that contain information about the age, gender and interests of customers. This data comes from interest-based advertising from Google and visitor data from third-party providers. They cannot be attributed to any specific person. Customers can deactivate this function via the ad settings in their Google account or generally prohibit the collection of their data by Google Analytics. If the customer does not want their website activity to be collected by Google Analytics, they can install the browser add-on to deactivate Google Analytics. This will prevent activity data from being shared with Google Analytics via the JavaScript executed on websites (ga.js, analytics.js and dc.js). The use of the add-on does not affect the analysis of data by other tools of the website operator. Data can still be sent to the website or other web analytics services.

Finally, imatrix.ai collects certain information about its website in server log files that are automatically transmitted by the customer’s Internet browser. This information includes the user agent (browser type and version, operating system used), HTTP header data (referrer URL, IP address of the accessing computer), time of server request and login status. These server log files are only used for error analysis together with other data sources.

Data collection and analysis for advertising purposes

The Provider’s website uses the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. Google Inc., located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”), is the provider.

The function makes it possible to link the advertising target groups created by Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. This allows interest-based, personalized advertising messages that have been customized on the basis of the customer’s previous usage and surfing behavior on one end device (e.g., cell phone) to be displayed on another end device (e.g., tablet or PC).

Provided that the customer has given Google appropriate consent for this, Google links the web and app browsing history with the customer’s Google account. This allows the same personalized advertising messages to be served on any end device on which the customer logs in with his Google account.

To support this feature, Google Analytics collects authenticated IDs of users, which are temporarily linked to imatrix.ai data to define and create target groups for cross-device ad advertising.

The imatrix.ai website also uses the online advertising program Google AdWords. Google Inc., with headquarters at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, is the provider.

Within the scope of Google AdWords, imatrix.ai uses the so-called conversion tracking. When the customer clicks on an ad placed by Google, a cookie is placed for conversion tracking. These small text files are stored by the internet browser on the customer’s computer. These cookies lose their validity after 30 days at the latest and are not used for identification. If the customer visits our website and the cookie has not yet expired, Google and imatrix.ai can recognize that the customer clicked on the ad and was redirected to this page.

The imatrix.ai only receives from Google the total number of users who clicked on its ad and were redirected to its website, which is tagged with a conversion tracking tag. However, the imatrix.ai does not receive any information with which it can personally identify the customers.

The customer may refuse the use of cookies by selecting the appropriate settings on their browser. However, imatrix.ai draws attention to the fact that in this case it may not be possible to use all the functions of this website to their full extent. The customer also has the option of preventing tracking by deactivating the Google conversion tracking cookie in the user settings of his internet browser.

The website of imatrix.ai additionally uses the visitor action pixel of Facebook. The provider is Facebook Inc. with headquarters at 1601 S. California Ave, Palo Alto, CA 94304, USA.

The Facebook pixel makes it possible to track the behavior of page visitors after they have been redirected to the imatrix.ai website by clicking on a Facebook ad. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimized.

The data collected is anonymous for imatrix.ai. imatrix.ai cannot draw any conclusions about the identity of the customers. However, the data is stored and processed by Facebook so that a connection to the respective user profile can be established. Facebook may use the data for its own advertising purposes in accordance with the Facebook data usage policy and enable the placement of advertisements on Facebook pages and outside of Facebook. imatrix.ai cannot influence the use of the data.

Integration of third-party offers / social media

The digital offerings of our imatrix.ai are networked with third-party functions and systems in a variety of ways. YouTube plugins are also integrated on our website. The provider of these plugins is YouTube LLC, headquartered at 901 Cherry Ave, San Bruno, CA 94066, USA. The YouTube plugin establishes a connection to the YouTube servers. In the process, YouTube is informed which pages of our offer you have visited. If you are logged into your YouTube account during this time, YouTube can assign your surfing behavior directly to your personal profile. The imatrix.ai website uses the Google Maps service via an interface. The provider of this service is Google Inc. with headquarters at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When the customer uses the functions of Google Maps, his IP address is recorded by Google and usually transmitted to a Google server in the USA. imatrix.ai has no influence on this transmission of data. Our website benefits from the connection to the renowned map service Google Maps. This allows us to offer our customers a high-quality and user-friendly map function. The company is one of the largest technology companies in the world and is known for its innovative solutions in the online sector. When our customers use the Google Maps features, their IP address is collected by Google. Generally, this data is stored and transmitted to a server of Google Inc. in the United States of America. As imatrix.ai, we have no direct influence on this data transmission. As a rule, iMATRIX GmbH does not carry out automatic individual decisions. Should imatrix.ai make automatic individual decisions in individual cases, it will inform the customer separately. In such a case, the customer has the option of having this decision manually reviewed by an employee of imatrix.ai.

To subscribe to the newsletter offered by imatrix.ai, imatrix.ai needs the customer’s email address and other information enabling it to verify that the email address provided is correct and that the customer has given his consent to receive the newsletter (double opt-in procedure). Through the newsletter, the customer receives regular recommendations and offers that may be of interest to him. For this purpose, personal data relating to the customer’s use of the website, iMATRIX GmbH and the newsletter (e.g. opening the newsletter, clicking on web URL links) is collected and processed. imatrix.ai analyzes this data for statistical purposes in order to better tailor the content of the newsletter to the customer’s interests.

The processing of personal data entered by the customer when subscribing to the newsletter is based on the customer’s consent, which the customer may withdraw at any time for the future. The revocation can be made via the “unsubscribe” link in the newsletter. The personal data collected will be used for the content design and dispatch of the newsletter. imatrix.ai will store the personal data provided by the customer for newsletter subscription until the customer unsubscribes from the newsletter.

The imatrix.ai stores and processes the personal data collected from the customer for as long as the customer uses the service. It should be noted that the contractual relationship between the iMATRIX GmbH and the customer is long-term.
